Introduction
These Terms and Conditions (“Terms”) apply to all services provided by Miks Adventures, a sole trader business registered and operating within the United Kingdom (“we,” “our,” or “us”). We provide professional babysitting and nanny services to local families in Teignmouth and surrounding areas, as well as outdoor instructing services, with a primary focus on watersports, to companies and activity centres.
By booking or using our services, clients (“you,” “your”) confirm that they have read, understood, and agreed to be bound by these Terms. These Terms exist to protect both parties and to ensure that all services are delivered in a safe, professional, and legally compliant manner.
 
Services Provided
Babysitting and Nanny Services
We provide childcare, babysitting, and nanny services, carried out in the child’s home or other agreed location. Services may include general supervision, meal preparation, bedtime routines, and engaging children in suitable activities. We do not provide medical or nursing care unless otherwise agreed in writing.

Outdoor Instruction Services (Watersports and Related Activities)
We deliver activity-based instruction, primarily watersports, to activity centres and companies. Services include instruction, supervision, and safety management during outdoor activities.
We reserve the right to amend the range of services offered at any time.
 

Bookings and Payments
  • All bookings must be made in advance and confirmed in writing, either by email or through a signed agreement.
  • A deposit may be required to secure a booking, which will be deducted from the final invoice.
  • Payment is due in full by the date specified on the invoice. Unless otherwise agreed, payment is required no later than seven (7) days after the service is delivered.
  • We reserve the right to withhold services if payment terms are not met.
  • Late payments may incur additional fees in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
 
Client Responsibilities
Childcare Services
  • Parents/guardians must provide full and accurate information about their child(ren), including medical conditions, allergies, dietary requirements, emergency contacts, and any special care needs.
  • The client must ensure the environment is safe and suitable for childcare.
  • The client must return home at the agreed time, or notify us promptly if there will be a delay. Any 15 minute lateness will be charged extra.
Outdoor Instruction Services
  • Clients/companies booking group sessions are responsible for ensuring all participants meet the minimum safety requirements (e.g., age, fitness, swimming ability where applicable).
  • Clients must ensure participants disclose any relevant medical conditions that may affect participation.
  • Clients must ensure that appropriate risk assessments have been conducted for group activities, in collaboration with us.
 
Safeguarding, DBS, and Conduct
  • All childcare and instructing services will be delivered with strict adherence to safeguarding standards in line with UK law.
  • We hold a valid Disclosure and Barring Service (DBS) certificate and will provide proof upon request.
  • We reserve the right to terminate services immediately if unsafe, abusive, or inappropriate behaviour is encountered.
 
Health, Safety, and Liability
  • We take all reasonable steps to ensure safety during service delivery. This includes compliance with UK Health and Safety regulations and industry best practice.
  • For watersports and outdoor activities:
    • All participants must wear safety equipment (such as buoyancy aids or helmets) as instructed.
    • Participants must follow all safety instructions at all times.
    • Failure to comply may result in removal from the activity, with no refund issued.
  • While we exercise reasonable care and skill, participation in outdoor activities carries inherent risks. By booking services, clients acknowledge and accept these risks.
  • We are not liable for injuries, loss, or damage arising from failure to follow safety instructions, pre-existing conditions, or actions outside our control.
 

Insurance
  • We hold appropriate Public Liability Insurance for up to £10 million covering babysitting, nanny, and outdoor instructing services in the United Kingdom.
  • Clients are encouraged to ensure they have adequate insurance coverage for their household or group activities where applicable.
 
Cancellations and Refunds
  • Cancellations must be made in writing at least 48 hours prior to the booking.
  • Cancellations made with less than 48 hours’ notice may incur a charge of up to 50% of the booking fee.
  • Where services are cancelled by us due to illness, severe weather conditions, or other unforeseen circumstances, the client will be offered an alternative booking date or a full refund.
 
Confidentiality and Data Protection
  • We respect your privacy and will handle personal data in line with the Data Protection Act 2018 and the UK General Data Protection Regulation (UK GDPR).
  • Any information you provide, including contact details and medical information, will only be used to deliver services safely and effectively.
  • We will not share your personal data with third parties unless required by law.
 
Force Majeure
We are not liable for any failure or delay in providing services due to events beyond our reasonable control, including but not limited to severe weather, natural disasters, illness, or government restrictions.
 
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
 
Acceptance of Terms
By booking or using our babysitting/nanny services or outdoor instructing services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
